Mr Pender says it is not easy to balance the tension between employers protecting their reputation and the employees’ right to express their personal views .And while these policies offer guidance, a media outlet is not allowed to prohibit a journalist from sharing their views online. If a journalist is releasing information or discussing views on a legally sensitive news story, this can increase the risk of defamation.
Personal social media posts do not go through the same legal steps as those taken for a news article online or a post published by a news outlet on social media. While an article will have an editor, another person to read over copy and potentially a lawyer if there are legal concerns – a tweet or Facebook post does not.
“There is an ethical responsibility to legally represent a journalist, when the post is about their work or is so intrinsically connected with the work,” Ms Lenard says. “But ultimately, whether an employer or a media outlet does represent a journalist if they are sued is a matter for the employer to determine, having regard to the content and the circumstances in which the post is made.”
