In a surprisingly short address that took less than five minutes, Mnguni said: “In this matter, I shall read the order. The order is as follows: the application is dismissed with costs, such costs to include those that occurred by the employment of senior counsel. I hand down the judgment. The court adjourns.”
He said the case was an application to suspend the warrants for the former president’s arrest and committal to prison. He also said the state capture inquiry’s argument that the court did not have jurisdiction to hear the application was a “red herring”.
Max du Plessis, acting for the Helen Suzman Foundation, was adamant the high court could not interfere with an order made by the highest court in the land. The high court application and a letter was written to the Constitutional Court requesting a stay of arrest pending Friday’s ruling by Mnguni and the outcome of his application to the Constitutional Court this coming Monday.In Zuma’s application to stay his arrest, his advocate, Mpofu, argued that he had been found guilty without trial and that the high court had jurisdiction to hear the matter and nullify a ruling of a higher court.
