Editorial | If you want evidence that our constitutional order can and does protect the powerless, look no further than this week’s Pietermaritzburg High Court ruling against the Ingonyama Trust board’s contemptible exploitation of the poor

A full bench ruled that the trust’s decision to convert permission-to-occupy land rights to long-term lease agreements and compelling residents to pay rent was unconstitutional and unlawful.The trust’s activities, the court found, were a deprivation and infringement of the rights of people living on Ingonyama Trust land.

The applicants who spearheaded the case were backed by the Rural Women’s Movement, the Council for the Advancement of the SA Constitution and the Legal Resource Centre.
