As aged care workers face mandatory COVID-19 vaccinations, more bosses across the private sector are considering a 'no jab, no job' policy. Experts say it is a legal 'grey area' that could lead to a flood of unfair dismissal claims.

A new industrial relations issue is on the horizon as employers begin to ask whether they can introduce a 'no jab, no job' policy for staff who refuse a COVID-19 vaccine.The Business Council of Australia says making vaccinations compulsory for some sectors makes senseAs the vaccination program progresses, and Australia moves from an elimination to a suppression strategy, the issue of vaccinations in the workplace is likely to heat up.

"At the moment, an employer can give lawful and reasonable directions to an employee to do the job, but the question is, is it lawful and reasonable for them to get a COVID-19 jab?" questioned Professor Stewart. Sandy Chong from the Australian Hairdressing Association said hairdressers have a range of opinions about mandating vaccinations.

More scare tactics nonsense from the far left ABC. As Australians, we expect, and deserve honest, serious, impartial journalism. Not this nonsense.

Some people can't get the vaccine for health or religious reasons. They may not be able to find employment if that's a problem. UBI for all. No more land lords.

Union demands seem very fair. Whether vaccine should be mandatory in certain sector or not, should come from medical experts, should not be left on the fancies of the employer.

A legal minefield

I hope those employers will also be providing compensation to the families of employees who get a blood clot, or die, if compulsory. The onus of responsibility for welfare is then on the employer, right?

Legally? No. You must consent to a vaccine without coercion or manipulation.

Certain jobs have certain requirements. For example anyone working with children (even the school bus driver!)must have a working with children check. The same must be applied here. Yes, make the vaccination mandatory. No jab no work, choose another job. Simple.

Alliance Airlines has already done this. Staff and contractors must be vaccinated when they are eligible. As a charter airline their clients can demand this.
