A long-running dispute over alleged illegal construction near a popular swimming spot in Kakadu National Park could be decided in the High Court, with lawyers for Parks Australia raising 'constitutional issues'.

But lawyers for Parks Australia requested the case be adjourned, raising "constitutional issues" of Commonwealth immunity in relation to the Sacred Sites Act in Kakadu National Park.

The court heard that notices had been issued to the federal and Northern Territory Attorneys-General in relation to claims of constitutional issues, which prevents actions in the Darwin Local Court from proceeding.
