The High Court will give a decision later today about whether or not a South African woman who is challenging her detention in hotel quarantine should be let out

It is the first challenge to the legality of hotel quarantine that will be decided by a High Court judge.Her lawyers said account should be taken of the fact that she has previously had Covid-19 and has had one dose of the AstraZeneca vaccine.They suggest this puts her in a similar position to a fully vaccinated person.

This morning, lawyers for the State said the Ms Heyns' right to liberty was competing with the rights of citizens who had chosen not to travel abroad. Mr Cush said the quarantine scheme was a proportionate response - given the objectives of the legislation to deal with a serious risk to public health, the threat to the effectiveness of vaccines, the impact on the health system and on society and the economy.

By doing so, he said they would be second guessing the Minister for Health, who acts on the advice of the Chief Medical Officer.
