Public protector Busisiwe Mkhwebane and Public Enterprises Minister Pravin Gordhan have failed to convince the high court of any merit to appeal parts of its order suspending Mkhwebane’s remedial action of the Sars ‘rogue unit’ judgment.

have failed to convince the high court of any merit to appeal parts of its order suspending Mkhwebane’s remedial action of the South African Revenue Service ‘rogue unit’ judgment.in Pretoria stated that leave to appeal may only be given when the judges are of the opinion that there would be a reasonable chance of success or a compelling reason the appeal should be heard, including conflicting judgments.

This comes after Mkhwebane challenged what she termed the abusive language used by Gordhan when he appealed and won against her remedial actions.In it, she found that Gordhan had misled parliament, had authorised the unlawful creation of an investigation unit in Sars and that the unit had conducted unlawful and unauthorised spying operations. The remedial action included that President Cyril Ramaphosa take appropriate disciplinary action against Gordhan within 30 days of her report.

Mkhwebane’s lawyer, Thabani Masuku SC, said Gordhan had accused Mkhwebane of promoting state capture and of corruption, and had even called on parliament to consider taking action against her. Mkhwebane has lost several court challenges, with damning findings being made about her competence. Her fitness to hold office is under scrutiny by parliament after the ANC voted with the Democratic Alliance to establish a committee to investigate the matter.
