Marijuana Possession Is Now Legal In New York; Criminal Records To Be Automatically Wiped Clean

Democratic Gov. Andrew Cuomo is expected to sign legalization into law as soon as Wednesday.

In addition to ending criminal penalties for possession and cultivation of cannabis, the bill allows New Yorkers to grow up to six plants at home—a right not afforded under legalization in nearby New Jersey. New York is the third state to legalize cannabis via a vote in the state Legislature rather than by voter initiative, after Vermont and Illinois.

A plan supported by Cuomo, that would have banned home grow and would have reserved coveted licenses to cultivate and sell cannabis for a few select corporations, was abandoned in 2019 because it did not go far enough towards what advocates called “restorative justice.”
