If U.S. election winds up in Supreme Court, Ginsburg's death will loom large

Before Ginsburg’s death, the court had a 5-4 conservative majority, so even if her seat were to remain vacant, Democrats would need two conservative votes to avoid losing or a 4-4 tie in any post-election case. A repeat of the situation in 2000, when the election came down to a few hundred votes in Florida out of 100 million cast nationwide, remains unlikely, experts said.

In April, a 5-4 decision by the bloc reversed a federal judge’s decision to extend the deadline for submitting absentee ballots during Wisconsin’s primary election. That ruling drew a scathing dissent from Ginsburg, who warned it would cause “massive disenfranchisement.” Roberts sided with the court’s liberal minority in several key cases earlier this year and has shown a desire to avoid turning the court into a partisan institution.

You have two judges that should recuse themselves if this ends up at the Supreme Court. Will they? Doubt it. But it would be 3-3 if they did.

I'm curious as to how the Senate is so gung ho on filling Ginsburg's seat but they can't come up with a stimulus plan for a lot of people who are suffering financially. I would think that would be their first priority!
