Retired Supreme Court Associate Justice Antonio Carpio strongly doubted the constitutionality of a bill that seeks to exclude telecommunications from the list of public utilities under the Public Service Act.In a webinar conducted by the Philippine Bar Association on Friday, Sept. 18, Carpio warned that aside from being unconstitutional, the country will face serious national security risk if the House of Representatives succeeds to have the bill enacted.
The former High Court magistrate added: “This is a battle of turf between the Congress and the Supreme Court. It is the Supreme Court that will decide and they will also decide that Congress cannot reserve the power of the Supreme Court to be the final arbiter of interpreting the constitution.” “That is a problem that the Philippines is allowing ChinaTel to install telecom equipment in military camps and the fact that we have a conflict with China,” he said.
