A former magistrate would be placed at "inevitable risk" if he is sent to prison for deception offences, the South Australian District Court has been told.Mr Harrap's lawyer claims he is at "inevitable risk" if sent to prisonBob Harrap is one of four people who've pleaded guilty, following an investigation by the Independent Commissioner Against Corruption.
"There is no doubt as a longstanding magistrate, a custodial sentence would place my client at high risk, inevitable risk, and there is always the prospect of him being systematically targeted by prisoners," defence lawyer David Edwardson QC said. "He's been punished enormously by the mere fact of admitting to that conduct, and he's lost his job."Prosecutor Peter Longson rejected most of the defence arguments, even unsuccessfully calling for the judge to revoke Mr Harrap's bail immediately.
That’s the toss of the coin if he gets a thumping, too bad.
Send to jail anyway; no privileges.
What's the old saying, do crime do the time....seeya!
Fuck that Magistrate, how many times has this grub said to those coming before the courts they should have thought about their actions before offending.
home detention surely.
His penalty should be no less than anybody else that is found guilty of the same offence, if not more given his position. He should have thought about the consequences of his actions before he did what he did
So a criminal is scared of other criminals. ok
Conviction means a sentence & if they are that confident he can't be protected then their system needs to be fixed. Not sending him to jail gives cause to doubt their honesty.
