The Department of Justice — along with three law professors and Indiana's Attorney General — is arguing that the Constitutional rights of the church should prevent a gay teacher from being able to sue over his dismissal from a Catholic high school.

INDIANAPOLIS – The Department of Justice is siding with Catholic leaders in Indianapolis over the firing of a gay teacher,Amicus briefs were filed Tuesday with the Indiana Supreme Court, asking for the dismissal of a lawsuit brought against the Archdiocese of Indianapolis by a Cathedral High School teacher who was fired over his same-sex marriage.

Last year, the archdiocese threatened to cut ties with Cathedral and Brebeuf Jesuit Preparatory School where Payne-Elliott and his husband respectively worked if the two remained employed at the schools.Payne-Elliott filed the lawsuit against the archdiocese in July 2019. A month later the archdiocese filed its own court documents arguing for the lawsuit to be dismissed on grounds that as a religious institution it should not be subjected to secular court interference.

“The trial judge’s actions here improperly interjected judicial power into ecclesiastical matters, and this court should dismiss the case before the judiciary suffers further loss of esteem," Hill said.
