Rubenfeld vehemently denies the allegations of sexual harassment. He says: “I absolutely, unequivocally, 100 percent deny that I ever sexually harassed anyone, whether verbally or otherwise. Yes, I’ve said stupid things that I regret over the course of my 30 years as professor, and no professor who’s taught as long as I have that I know doesn’t have things that they regret that they said.”
Rubenfeld claims that people have lied about him in retaliation for things that he’s written and because his wife championed the nomination of Brett Kavanaugh to the Supreme Court. He also says that his suspension is based on anonymous accusations.: “I reported because I was sexually harassed. Now he’s being dishonest about even this aspect of the Title IX process. For example, as Yale’s policy requires, I identified myself to him.
It is hard to know what to make of this. It sounds as though at least one accuser filed a formal complaint and revealed her name. But the Yale policy clearly allows other students to speak with the university investigators anonymously. And it is impossible to know what exactly Rubenfeld was found to have done wrong. As noted earlier in this post, the investigators apparently determined that Rubenfeld harassed “several students” over a period of “decades”.
Therefore, it is impossible to know what Rubenfeld was found to have done wrong. It could be anything from attempting an unwanted kiss on the cheek thirty years ago to something more serious. It could mean that as few of three such incidents took place, all many years ago or that a greater number occurred more recently.
Of course, it is also possible that the university found hard evidence of six or seven very serious incidents of misconduct spanning Rubenfeld’s entire career at Yale. The public can’t know because Rubenfeld is not allowed to comment on confidential allegations. He says that he is “outraged by the outcome” and is considering his options.
