Facebook allegedly violated an Illinois law requires companies collecting biometric data to obtain prior consent from consumers.

Facebook has won preliminary approval from a federal court in California for settlement of a lawsuit that had accused the company of illegally collecting and storing biometric data of millions of users without their consent, Reuters reported.Last month, the company had raised its offer by $100 million to $650 million to settle the lawsuit which had accused the company of violating Illinois’ Biometric Information Privacy Act .

The court has given preliminary approval to the amended offer and a final approval hearing has been set for January 2021. The Illinois law requires companies collecting biometric data to obtain prior consent from consumers, detail how they’ll use it and how long it will be kept. According to the suit, the company violated the state’s law through its “Tag Suggestions” feature for photos, that allowed users to automatically recognize their Facebook friends from previously uploaded photos.in Illinois that accuses the company of violating BIPA by allegedly collecting facial recognition data, location data and data on close contact from minors, and discreetly sends it to servers in China.

TikTok’s lawyers have refuted these allegations, arguing that the app neither captures any biometric information nor does it send any data to China.The use of facial recognition technology by big tech companies and law enforcement has recently faced pushback from privacy and civil liberties activists, who argue that the technology is both flawed and enables a surveillance state.
