KUALA LUMPUR: A press statement by former attorney general Tan Sri Mohamed Apandi Ali that supposedly cleared Datuk Seri Najib Razak from any wrongdoing in 2016 was not conclusive, as it was based on evidence gathered by the Malaysian Anti-Corruption Commission (MACC) and disclosed in the investigation paper at that time, the High Court says.

Justice Mohd Nazlan Mohd Ghazali said this in his written summary judgment in the SRC International Sdn Bhd trial, where Najib was convicted of all seven charges relating to the misappropriation of RM42mil from the company’s funds.

In January 2016, Apandi released two press statements on the investigations into 1Malaysia Development Bhd and SRC International Sdn Bhd. In the second statement on Jan 26,2016, titled “In relation to the investigation papers returned by MACC on SRC International and RM2.6bil”, Apandi said he was satisfied that the RM2.6bil was given to Najib by the Saudi royal family and closed the investigation.

“It is thus undeniable that the charge under Section 23 of the MACC Act 2009 subsequently had the benefit of additional evidence which was not previously available at the time the announcement was made by the AG to NFA the investigations, ” he added.
