The Supreme Court has set a precedent for the resumption of the federal death penalty.

Daniel Lewis Lee, a convicted murderer, was executed Tuesday morning in the first federal execution in 17 years after the Supreme Court issued an overnight ruling that the execution could proceed — with the unsigned order that was released after 2 a.m. on Tuesday, the Supreme Court has set a precedent for the resumption of the federal death penalty.... [+]Lee, who was convicted in 1999 of killing a family of three, was pronounced dead at 8:07 a.m.

“It is our responsibility ‘to ensure that method-of-execution challenges to lawfully issued sentences are resolved fairly and expeditiously,’ so that ‘the question of capital punishment’ can remain with ‘the people and their representatives, not the courts, to resolve,’” the justices wrote quoting past decisions.

In dissent, Justice Stephen G. Breyer reiterated his concern that the death penalty may be unconstitutional and Justice Sonia Sotomayor said the high court had acted too quickly to resume the federal death penalty.
