Italy's Prime Minister Giuseppe Conte said the independence of the European Central Bank is key to the foundations of the European Union and no constitutional court should decide what it can do, in an interview published on Wednesday.

ROME - Italy’s Prime Minister Giuseppe Conte said the independence of the European Central Bank is key to the foundations of the European Union and no constitutional court should decide what it can do, in an interview published on Wednesday.

“It is not up to any constitutional court to decide what the ECB can or cannot do. Its independence is the fulcrum of the European treaties, which are recognised by Germany too,” Conte told newspaper Il Fatto Quotidiano in an interview. Conte said Italy did not need the European Stability Mechanism but it would be hard for the new European Recovery Fund, built to help countries recover from the coronavirus pandemic, to take off before the summer.

The ruling coalition already approved in March a 25 billion euro package to help the economy cope with the outbreak.

The German constitutional court is referring to the Bundesbank not the ECB directly. But the corollary of such an unhappy declaration lies in the implied and accepted understanding that the ECB in Mr. Conte opinion is above all Constitutions in the EU including the Italian one.

Italy's PM did not understand the judgment of the Karlsruhe Court, which did not decide the tasks of the ECB but the limits beyond which the German constitutional bodies cannot follow the decisions of the ECB. Giuseppi is very upset because he knows that he has to resign soon.

But a constitutional court can decide whether the ECB has authority over that member state, as the sovereignty is at the member state level, not at the EU. The EU & ECB depend on the mandate of the member state´s democratic decisions to transfer certain powers to the EU. BVerfG
