Jacela was initially charged for violating Section 7 of R.A. 6713 or the Code of Conduct and Ethical Standards for Public Officials and Employees because of his receipt of money from a bank which had a pending request from the city council.
However, there was an issue with the donation because he knew fully well that the bank had a pending request for reconsideration before the Sangguniang Panlungsod of Tayabas to terminate its services as depository bank of the city government. The prosecution gave its consent, as well as on the behalf of the complainant. The prosecution likewise manifested that the civil liability of Jacela has been satisfied.
