The High Court has dismissed a challenge against An Bord Pleanála's decision to grant approval for the 14km long M28 motorway between Cork city and Ringaskiddy.

In a lengthy and detailed judgment Justice Michael MacGrath said despite the skillful arguments by the group's barrister, Oisin Collins Bl, the court was not convinced that the project was not properly assessed by the board before it made its decision. It also argued that there was a failure by the board to consider the whole project or the cumulative effects of the proposed development.

Material is to be extracted from the quarry to construct the proposed roadway at a rate that between 10 and 30 times greater than what is permitted, the group further claimed. It also said that the potential cumulative effect of the road development and the quarrying had been addressed in an Environmental Impact Statement and the boards own assessment of the site.

It also argued by the council that some of the points raised by the group in its proceedings were previously raised at an oral hearing in respect of the proposed scheme.
