“When I was briefed, I went there to challenge the police officers so that the victims could be granted administrative bail or taken to court. Surprisingly, the police demanded N400,000 for bail, but I told them that bail was free as long as the victims had responsible sureties. During the court proceedings, Oshinyemi said the judge exonerated him of all the charges and ordered the police to pay to him N10m in damages, but explained that the police had defaulted in making the payment.
“In the light of this, I hold that the 2nd and the 3rd respondents have not established before this court that the detention of this applicant was lawful and within the confines of the Constitution. “This court has, therefore, found that the 2nd and 5th respondents violated by infringing the right of the applicant to personal liberty as guaranteed by Section 35 of the 1999 Constitution ; he is entitled to damages.
