PETALING JAYA: The by-election for the Nenggiri state seat in Kelantan has been called but the former assemblyman Mohd Azizi Abu Naim still has legal avenues to halt the polls, say legal eagles.

Mohd Azizi sought a court declaration that the by-election should not be held by the Election Commission as the seat was still his. Senior lawyer Mohamed Haniff Khatri Abdulla said Mohd Azizi could seek an interim stay in the Court of Appeal pending his legal action to challenge the Speaker’s decision.Lawyer Andrew Khoo, too, said Mohd Azizi can appeal the decision of the interim injunction application to stop the EC from conducting the by-election or file for leave to apply for judicial review.

“If there are different rulings from the respective Speakers on the same question of law, though they have the discretion to do so, it will be a mockery of the law because it is all on the same interpretation of the law ,” he said.
